Transferring a work authority
In order to transfer a work authority, complete a transfer application form and return it to ERR along with any supporting documentation listed on the form.
When ERR receives the completed transfer application form, the work authority will be assessed for any further action that may be required in order to progress the transfer.
This may include any of the below actions:
- Payment of the transfer application fee (this will be invoiced on receipt of the completed transfer application form).
- Submission of all outstanding annual returns and payment all outstanding invoices in respect of the work authority.
- Completion and submission of a final annual report (which will also incur an invoice for payment).
- A bond review assessment.
- Submission of a replacement rehabilitation bond by the transferee.
- Evidence of a current planning permit.
Additional actions and supporting documentation may be required - you will be advised of this in due course when the completed transfer application form has been received and the work authority has been assessed.
Please note that any existing bond will be returned to the transferor on approval of the transfer.
Surrender a work authority
A work authority may, with the consent of the Minister, surrender the work authority, by notice in writing using the approved form.
The approved form should be signed by all authority holders and emailed to licensing.err@deeca.vic.gov.au.
A surrender request may not be progressed until all outstanding matters have been addressed, including payment of outstanding fees, or submission of returns/reports. A final annual report (which will incur an invoice for payment) will need to be completed and submitted through the RRAM portal. A surrender has no effect until the notice of surrender is registered.
Additional actions and supporting documentation may be required - you will be advised of this in due course when the completed notice of full surrender has been received and the work authority has been assessed.
Until the Minister has consented to the surrender of this work authority, compliance with the Mineral Resources (Sustainable Development) Act 1990 and the Mineral Resources (Sustainable Development) (Extractive Industries) Regulations 2019 is required.
Following the surrender of the work authority, any existing bond will be returned to the work authority holder when all rehabilitation requirements have been satisfactorily addressed.
