Over-extraction frequently asked questions (FAQs)
How do I know if I have over-extracted?
Check your work authority document, work authority conditions, approved work plan and work plan conditions. If your site is operated under the code of practice the work authority document and the code will be your key reference documents. These documents are important to understand where extraction is permitted.
Work authority boundaries and extraction limits are required to be marked with posts. The details are specified in the conditions. Work authorities are required to have the boundary posts surveyed in.
How do I get a copy of my work authority, work authority conditions, work plan or work plan conditions?
It is a requirement of the regulations to have a copy of the work plan and conditions on site at all times. If you have any questions, contact ERR on errfeedback@deeca.vic.gov.au.
What do I do if I think that I may have over-extracted?
- Cease extraction or other activity in the area that is not authorised.
- Contact ERR on errfeedback@deeca.vic.gov.au. We will arrange a site visit and advise on next steps.
What if I took the work authority over from someone else who had over-extracted?
The current work authority holder is responsible for ensuring that the site is compliant with the approved work plan and conditions.
What happens if I have over-extracted?
ERR can issue remedial notices to require an authority holder to address non-compliance. For over-extraction this may include requiring the authority holder to:
- cease extracting or other activity outside of the approved area
- return the work authority to the area and profile approved in the work plan
- demonstrate that boundary and extraction limit posts are in the right location
- rehabilitate the area not authorised to be disturbed, including filling, topsoiling and establishing vegetation.
Non-compliance with remedial notices can result in further enforcement action including infringement or prosecution.
