Body Worn Camera collection notice

The Department of Energy, Environment and Climate Action (DEECA) is committed to protecting personal information in accordance with the Privacy and Data Protection Act 2014 (Vic).

Who is collecting your information

DEECA, through its Resources Victoria authorised officers, collects personal information using body worn cameras when authorised officers are performing their lawful functions.

Why body worn cameras are used

Body worn cameras are used to record interactions with landowners, occupiers and members of the public for safety, regulatory compliance and evidentiary purposes, including land access and enforcement activities.

What information may be collected

When a body worn camera is activated, personal information that may be collected includes:

  • images and audio recordings of individuals involved in the interaction
  • statements, opinions or behaviour captured during the interaction
  • contact details you choose to provide
  • images of documents you present to an authorised officer.

How collection occurs

Recording generally occurs during face‑to‑face interactions undertaken as part of authorised officer duties. Where reasonably practicable, authorised officers will advise you that recording is taking place at the time of the interaction.

Legal authority

Personal information is collected under the Electricity Industry Act 2000 (Vic) and associated legislation, which authorises DEECA authorised officers to undertake land access, compliance and enforcement

Use and disclosure

Recorded information is used only for purposes related to officer safety, compliance, enforcement and associated investigations.

Information may be disclosed to VicGrid where necessary and authorised to support land access, compliance or enforcement activities, or where required or authorised by law, including to law enforcement agencies or courts.

Storage and security

Body worn camera recordings are stored in DEECA‑controlled information systems (or systems provided by DEECA’s contracted service providers). Access is restricted to authorised personnel.

Retention and disposal

Recordings are retained and disposed of in accordance with DEECA’s records management and information retention obligations.
